These Terms of Service ("Terms") govern your use of the Virtual Private Server ("VPS") hosting services ("Services") offered by DeployKVM LLC ("we," "us," or "our"). By using our Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you are not authorized to use the Services.

1. Services
We provide VPS hosting services, which include dedicated resources on a shared server, root access, and the ability to install your own software. We offer various VPS plans with different resource allocations (CPU, RAM, Disk Space, Bandwidth).

2. Your Responsibilities
You are responsible for all content stored on your VPS and all activity occurring on your VPS.
You agree to comply with all applicable laws and regulations in your use of the Services.
You are responsible for maintaining the security of your VPS, including keeping your software up to date and using strong passwords.
You agree not to use the Services for any illegal or unauthorized purpose. This includes, but is not limited to, copyright infringement, spamming, or launching denial-of-service attacks.
You agree to back up your data regularly. We are not responsible for any data loss.

3. Resource Usage
Your VPS plan has specific resource allocations (CPU, RAM, Disk Space, Bandwidth). You agree not to exceed these allocations for extended periods. We reserve the right to take action, including service suspension or termination, if your resource usage impacts the performance of other users' VPS instances.

4. Payment
You agree to pay for the Services in accordance with the chosen plan and billing cycle.
We accept various payment methods, which are listed on our website.
We reserve the right to suspend or terminate your account if payment is not received on time.

5. Term and Termination
These Terms are effective upon your acceptance and remain effective until terminated by you or us.
You may terminate your account at any time by contacting our support team.
We may terminate your account or suspend your access to the Services for any reason, including, but not limited to, a violation of these Terms.

6. Backups
We strongly recommend that you back up your data regularly. We are not responsible for any data loss.

7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification
You agree to indemnify, defend, and hold us harmless from and against any and all claims, losses, damages, expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Services or your violation of these Terms.

10. Modifications to the Terms
We may revise these Terms at any time by posting the revised Terms on our website. You are responsible for checking the Terms periodically for updates. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws provisions.
